By creating an account or using Freshdesign ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and Freshdesign Interactive, Inc. ("we", "us"), operating from San Jose, California, USA.

You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement. The Service is intended for professional use by product designers, product managers, and software teams.
You sign in using your Google or GitHub account. You are responsible for maintaining the security of your OAuth credentials. You may not share your account or transfer it to another person. If you suspect unauthorized access to your account, notify us immediately at info@freshdesign.com.

The Freshdesign design system, including all components, tokens, patterns, documentation, and the underlying source code, is the intellectual property of Freshdesign Interactive, Inc. Nothing in these Terms transfers ownership of that IP to you.
The configured design system files you download are licensed to you for use in your own projects, including commercial client work. A formal license agreement will be issued as the product matures out of beta.
You retain full ownership of any designs, products, or applications you build using Freshdesign.
Payments are processed securely through Stripe. All fees are stated in US dollars. Because access is granted immediately upon payment, we do not offer refunds unless required by applicable law. If you believe you were charged in error, contact us at info@freshdesign.com within 7 days of the charge.
If you submit feedback, suggestions, or bug reports through the Service, you grant us a perpetual, royalty-free license to use that feedback to improve the product. We will not attribute feedback publicly without your permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
This disclaimer is especially applicable during the beta period, where downtime, data loss, or breaking changes may occur without notice.
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR ACCESS. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
We may suspend or terminate your access at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to access the Service ceases immediately. You may request deletion of your account data by emailing info@freshdesign.com.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Santa Clara County, San Jose, California, and you consent to personal jurisdiction in those courts.
Before initiating any formal proceeding, you agree to contact us at info@freshdesign.com and attempt to resolve the dispute informally for at least 30 days.
We may update these Terms from time to time. We will notify users by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
